SALES CONTRACT – PRODUCT ORDER

The information contained in the Terms of Use and the details contained in ypodimatakaldis.gr do not constitute a sales proposal but an invitation for information.

No contract shall be deemed to have been formed between us and you in respect of any products, unless your order is expressly accepted by us. If we do not accept your order and the money has already been taken from your account, then it will be refunded in full free of charge.

To place an order you will be asked to follow the purchase process and press the "SEND ORDER", "PROCEED TO PAYMENT" or "COMPLETE ORDER" button. You will then receive an e-mail from us confirming receipt of your order (“Order Confirmation”). Receipt of the email confirms the completion of the order and its acceptance by us.

AVAILABILITY OF PRODUCTS

All product orders are subject to availability. In this light, in the event of difficulties in supplying or running out of products in stock, we reserve the right to inform you, either by telephone at the number you have indicated or by email, about similar products of equal or superior quality and value, which you can order. If you do not wish to order such similar products, we will refund any amount you may have paid in full free of charge.

REJECTION OF ORDER

We reserve the right to withdraw any product from ypodimatakaldis.gr at any time and/or to remove or edit any material or content on this website. Although we make every effort to process all orders placed with us, exceptional circumstances may arise where we may need to decline to process an order after we have already sent you the Order Confirmation, which we reserve the right to do at any time at our sole discretion.

DELIVERY – NON DELIVERY OF PRODUCTS

Subject to condition 5 above regarding product availability and subject to exceptional circumstances, we will use our best endeavors to complete your order for the product(s) within the days specified through the / of the carrier / carriers cooperating with us and in any case within 30 days at the latest from the date of the Order Confirmation. The delivery of the products is carried out through the carrier(s) cooperating with us and their shipping time in Greece is between 1-3 working days from the next working day of the Order Confirmation. We do not make deliveries on Saturdays and Sundays.

However, delays may occur in cases such as , depending on the delivery area or in unforeseen circumstances.

If for any reason we are unable to meet the delivery date, we will notify you and offer you the option of either continuing with the purchase by setting a new delivery date from us, or canceling the order with a full refund free of charge.

For the purposes of these Terms, “delivery” shall be deemed to have taken place or the order shall be deemed to have been delivered when you or a third party on your behalf, other than the carrier, has obtained physical possession or control of the products, the which will be evidenced by the signature of the proof of receipt of the order at the agreed delivery address.

If it becomes impossible for the carrier to deliver your order, they will leave you a note explaining where your order is and what you will need to do to collect it and will also contact you by phone. If, after 10 days from when your order is available for delivery, that order has not yet been delivered for reasons not attributable to us, we will consider that you wish to cancel the Contract and the Contract will be deemed to have expired. As a result of the termination of the Contract, we will return to you free of charge any payment received from you as soon as possible and in any case within 14 days of the date on which the Contract has ended.

In the event that your order is lost due to an error by the carrier, we will inform you about this and, if you still wish to complete the order, we will replace and resend the same products to you, otherwise we will return to you free of charge any payment we received from you.

PAYMENT FOR PRODUCTS

The price of each product is the one set at any time on ypodimatakaldis.gr, except in cases of obvious error. We always take care to ensure that all prices on the website are accurate, however errors may occur. If we discover an error in the price of any product you have ordered, we will notify you as soon as possible and give you the option of reconfirming the order at the corrected correct price or canceling it. If we are unable to contact you, we will treat your order as canceled and refund you in full any amount you have paid.

We are not obliged to supply you with any product at the incorrect lower price (even if we have sent you the Order Confirmation), where the error in price is obvious and undisputed and can reasonably be recognized by you as an incorrect price.

The prices on our website include VAT but not shipping costs, in the event that you incur Shipping Costs.

Based on our company's policy, the shipping costs for your purchases within the Greek territory over €35 are free for you, while for purchases under €35 you are charged the amount of three euros and fifty cents (€3.50) in the cases of payment by card and the amount of five euros (€5.00) in case of Cash on Delivery. Prices may change at any time, however, subject to what is specifically stated immediately above, any changes will not affect orders for which an Order Confirmation has already been sent to you.

Once you have selected all the products you wish to buy, they will be added to your shopping cart and the next step is to proceed with the order and pay. To do this, you must follow the steps of the purchase process, completing or verifying the information requested at each step. Furthermore, during the purchase process, before payment, you can change the details of your order.

Payment can be made via cash on delivery, payment via Nexi in collaboration with Alpha bank and payment at our physical store.

At the moment you press the button "SEND ORDER", "PROCEED TO PAYMENT" or "COMPLETE ORDER" you confirm that your credit card is valid and has sufficient balance. Credit cards are subject to validity and approval checks by your card issuer. If your card issuer does not authorize payment, we will not be liable for any delay or non-delivery and will not be able to enter into a Contract with you.

INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS – TRADEMARKS
